Terms of Service

These Terms govern your use of the KiwiABC website and games at kiwiabc.co.nz (the "Service"), operated by Kiwiland Education Limited ("we", "us"). By using the Service or subscribing, you agree to these Terms.

The Service

KiwiABC provides decodable "literacy mystery" games for children, aligned to the New Zealand Ready to Read Phonics Plus sequence. The first few mysteries in each phase are free to play with no account. A paid subscription unlocks all mysteries and adds accounts, student logins, saved progress, and a teacher dashboard.

Accounts

To subscribe or save progress you create a teacher or parent account. You must be an adult (18+) to create an account. You are responsible for keeping your password safe and for activity under your account. Student profiles are created and managed by the account holder, who is responsible for any necessary consent to add a child and for the information they enter.

Acceptable use

Please use the Service only for its intended educational purpose. You agree not to misuse it — for example, attempting to break security, access other accounts' data, resell access, or disrupt the Service.

Subscriptions, billing & cancellation

• Plans & prices: current plans and prices are shown on our Plans page. All prices are in New Zealand dollars and include GST.
• Billing cycle: you choose per-year or per-term billing (NZ school terms — 4 a year). Payments are processed securely by Stripe.
• Auto-renewal: subscriptions renew automatically at the end of each billing period until cancelled.
• Cancellation: you can cancel anytime from your account ("Manage billing"). Your access continues until the end of the period you've paid for; we don't charge you again after you cancel.
• Refunds: except where required by the New Zealand Consumer Guarantees Act or other law, payments are non-refundable. If something isn't right, contact us — we'll work with you fairly.
• Price changes: we may change prices; any change applies from your next renewal, and we'll give reasonable notice.

Content & intellectual property

All games, text, designs, and branding on the Service are owned by us or our licensors and are protected by law. You may use the Service for personal, family, or classroom learning, but you may not copy, redistribute, or resell our content without permission.

Availability

We aim to keep the Service running smoothly but can't guarantee it will always be available or error-free. We may update, change, or pause features from time to time.

Consumer rights

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986 where they apply.

Liability

To the extent permitted by law, and except for the consumer rights above, we are not liable for indirect or consequential loss arising from your use of the Service, and our total liability is limited to the amount you paid us in the 12 months before the claim.

Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date; continued use means you accept the changes.

Governing law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
